Please read through these Conditions of Sale carefully as they form the agreement under which we will supply products and services to you.
It's important to note that in our quest to offer the best pool equipment many of the brands from whom we source our products operate under trade agreements. This basically means we are an agent for their brand, an arrangement whereby - technically - you are transacting with the brand even though you are dealing through us. This may apply to certain products from brands such as:
Astral Pool, Zodiac, Pentair, Onga, Poolrite, Waterco Water TechniX, Davey
When buying products from these manufacturers, you will be subject to their terms and conditions, which will prevail over these Conditions of Sale if there is any inconsistency. Delivery of these products will usually be by Mr Pool Man.
Order and Availability
When you have ordered a product from us by paying for the product in full, a binding agreement will come into existence between you and us. Only these Conditions of Sale will apply in relation to the supply of the product. Orders for a product will not be placed or dispatched until you have paid for the product in full.
Orders changed or cancelled may incur a restocking fee if they have been custom ordered in at your request. This will be the decision of management depending on the product and time frame.
All stock availability as represented by our sales team is accurate in accordance with our current stock levels. However, if, for any reason, we cannot supply a product you have ordered, we will let you know using the details provided by you to amend, cancel or delay delivery until stock arrives as agreed with you. If you choose to delay your order, we will contact you to arrange for delivery once the product is available.
In the event of a model or range change by a manufacturer we will endeavour to notify you as soon as possible and attempt to secure the product or offer the best alternative to equal or greater value.
Prices and Payment
All prices are AUD and inclusive of GST. Regarding pricing mistakes or errors, we make every effort to ensure prices and product information displayed on our website, catalogues or advertisements are correct and up-to-date.
Prices and discounts for our products displayed on third party websites may not be correct and we are not bound by them. We accept no liability for products that are superseded prior to payment in full has been made.

We accept payment by VISA, MasterCard credit cards, Afterpay, Zip Pay and other “Buy Now Pay Later” methods.
Your tax invoice will be sent to you via email when the items you have ordered are sent. Your tax invoice is your proof of purchase and may be required for any warranty claims.
You must apply the discount code (one word) to your cart at checkout to receive the discount. Only one (1) promo code can be applied to a single order. The promotion cannot be applied to an order that has been completed, nor can the code be applied to an invalid order. If the code is a one-time-use code, this code cannot be reapplied to a second order if the first order is cancelled, or if the order is returned for a store credit. Codes are only valid for orders placed through Mr Pool Man All offers not valid with any other coupon code or offer.
- Promotions, discounts and promotional codes (collectively "Promotions") are valid for the specified time period for online purchases of merchandise only and may be used one time only unless otherwise stated.
- One time use Promotions must be used in their entirety in a single purchase. Any amounts not redeemed in the applicable purchase will be forfeited. Promotions cannot be combined with other promotions.
- Promotions do not apply to gift certificates, shipping, GST or duties or similar services.
- Promotions cannot be applied retroactively to previously placed orders or to orders that have been adjusted.
- For promotions requiring a minimum order size, charges for shipping and credits from gift certificates do not count towards the minimum order size requirement.
- For promotions where you must buy 1 (or more) item(s) to get a reduction on the second (additional) item(s), the discount will be applied at checkout to the lower priced item.
- If you return a gift that was purchased with a Promotion and the Promotion has expired, you cannot apply the expired Promotion to a replacement or future order.
- Promotional items are available only while supplies last; Mr Pool Man does not issue rain checks for items that run out of stock.
- Mr Pool Man can, at its sole discretion, extend or terminate a Promotion at any time.
- Mr Pool Man has no obligation to advise an entrant of an incomplete or incorrect entry and will not be accountable for the return of any item ordered incorrectly.
- By claiming a promotional offer on your order, you agree that you have understood the terms and conditions of that promotion.
- All promotional spend levels and discounts are in Australian Dollars (AUD).
- $10 gift cards may not be combined with any other promotional offer and cannot be used in multiple quantities on a single order.
- Some promotional offer gift cards may not be combined with any other promotional offer or promo code offer.
Shipping & Delivery
We offer free delivery for all orders Monday to Friday within our standard national delivery areas.
If you need to change a scheduled delivery date or the delivery address, please let us know at least 48 hours before the delivery date. If you are not available to take delivery on the agreed delivery date, and a card is left and the item now collected within required time frame and is Returned to Sender (us) you will be required to pay a re-delivery fee of $9.95 to have the item resent, preferably to an address that can collect the order.
In most instances, delivery will be via standard tracked economy shipping usually by Australia Post – if neither you nor your authorised representative are available at the delivery address to take delivery, an “Article Awaiting” card will be left at the delivery address and your order will be taken to the Australian Post Office suitable to store the product until you are able to go and pick it up. In these circumstances our obligation to deliver the product to you is satisfied when the “Article Awaiting” card is left at the delivery address.
In case of a disputed delivery or missing item, Mr Pool Man will only replace orders using the same shipping method order was placed with providing the order is proved lost in transit by our delivery company. Mr Pool Man has the right to obtain shipping details (proof of delivery by proof of signature) to provide as proof if dispute is started.
Certain factors such as order size, weight and shipping address may require us to ship via another method. Mr Pool Man reserves the right to change your shipping method in these cases and will provide tracking details for the new carrier once shipped.
The delivery times provided by Mr Pool Man and associated carriers are estimates only. Mr Pool Man will not be held accountable for late deliveries or loss or damage relating to late deliveries.
In the event that multiple items are ordered, part deliveries may be made where stock is not available. All reasonable attempts to notify you will be made using the details you provided. By agreeing to our terms and conditions you acknowledge all information set forth under our shipping pages.
Disputed deliveries need to be made within 60 days of shipping notification, as carriers cannot open investigations with items that have not been delivered past 60 days. As the customer you need to proactively contact us if your order has not been received 30 days after receiving the shipping notification to allow 30 days for an investigation if required.
After 60 days the customer assumes all responsibility for the order and we as the retailer consider the item delivered. After 60 days no reimbursement, refund or replacement will be sent due to a shipping dispute.
The shipping address for your order is shown in the checkout and on your order confirmation and shipping confirmation emails. In the event that an incorrect address was entered, address changes can only be made until the order begins processing. Mr Pool Man cannot accommodate all address change requests.
Mr Pool Man takes no responsibility for orders shipped to an incorrect or invalid address and is not liable for any loss or costs associated with redelivery or replacement due to user error.
Some international orders may incur a customs or import duty charge. Mr Pool Man does not have any control over these charges or are unable to advise what they will be, as it is based on your own countries regulations & compliances. For further information, please contact your local customs office.
All charges are to be paid by the customer on delivery of order. Orders cannot be returned to sender and Mr Pool Man will never pay these customs charges on your behalf. If you refuse to pay these charges your parcel may be abandoned, and Mr Pool Man will not be held responsible for any loss of funds as a result of this occurrence. We cannot mark International orders as a gift in order to bypass or reduce any customs fees. This is an illegal practice and as an established business we will not do this.
Orders that are obviously large, heavy and bulky will be sent on a pallet, and may require a forklift to unload, OR if a forklift is not available, hand unload will be required. This is the customer's responsibility entirely, and if delivery cannot be made to the address due to accessibility or unload reasons, it will be taken back to the depot for pick up from the customer or possible re-delivery. Please note that if there are additional charges for re-delivery etc this will be the responsibility of the customer.
Warranties and Limitation of Liabilities
For any claim for warranty please refer to the attached and below manufacturer’s warranty schedule and terms and conditions via the website links.
Warranty action is determined by the product and its respective warranty cover. Some products are replacement only, workshop only and infield cover and different products have different periods of cover for both parts and labour.
For direct replacement warranty the matter is usually actioned by the manufacturer’s as this is the quickest source of resolution. For all other matters, the issue must be determined and what caused it by an authorised service agent to inspect and assess and they will determine if the issue is product related or not.
The service agent will refer back to the manufacturer if needed to assist with actioning any matter. The manufacturer will cover parts and labour for any product related matter if determined by the service agent inspection and within the warranty period for labour and parts, except for those exceptions as detailed in the terms and conditions.
Customers will be charged by service agents for the following – inspection, non product related matters, out of labour warranty period for that product. From time to time the manufacturer might want to get the product back for closer inspection. Time frame subject to the service agent level of business activity to action and complete once accepting claim is 3-5 business days.
Without limiting Australian Consumer Law, products sold by Mr Pool Man, Fluidra, Davey, Pentair, Pool Systems, Water TechniX, Poolrite and other manufacturers or suppliers are designed for use with swimming pool water balanced in accordance with Australian Standard AS3633-1989 with a pH range of 7.0 - 7.8. Maximum chlorine readings should not exceed 4ppm. Where pool water is not maintained within these parameters, Mr Pool Man, Fluidra, Davey, Pentair, Pool Systems, Water TechniX, Poolrite and other manufacturers or suppliers will not be responsible under this express warranty for any resulting damage, including damage caused by corrosion, scaling or stress loading.
Nothing in these Conditions of Sale limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (“ACL“) (or any liability under them) which by law may not be limited or excluded.
“Our goods come with warranties and guarantees that cannot be excluded under the Australian Consumer Law (“Consumer Guarantees“). You are entitled to a replacement or a refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure”.
Your product may come with a manufacturer’s warranty. The manufacturer’s warranty is in addition to but may overlap with any rights and remedies you may have under applicable law, including under the ACL.
This is a representation that if the goods (or part of them) are defective, the Manufacturers or suppliers will:
- repair or replace goods (or part of them)
- resupply or fix a problem with services (or part of them)
- provide compensation to the consumer.

Subject to this clause, and to the extent permitted by law, including under the ACL:
(a) all terms, guarantees, warranties, representations or conditions which are not expressly stated in these Conditions of Sale are excluded;
(b) we will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, damage to goodwill, arising out of or in connection with the products, the services or these Conditions of Sale (including as a result of not being able to use the products or services or the late supply of products or services), or the need to recover, re-program or reproduce any program or data stored in or used with the products purchased from us, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise; and
(c) our total liability arising out of or in connection with the products, the services or these Conditions of Sale, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the total price paid by you for the purchase of products and services under these Conditions of Sale.
Where by law we are unable to exclude terms, guarantees, warranties, representations or conditions but are able to limit them, to the extent permissible by law we limit our liability for any breach, at our option, to the repair or replacement of products, or payment of the cost of repairing or replacing the products or in the case of services, to supplying the services again or the cost of having the services supplied again.
To the extent permitted by law, any typographical, clerical or other error or omission in sales literature, quotation, price list, acceptance or offer, invoice or other documents or information issued by us will be subject to correction without any liability on our part.
You must inspect the products for any superficial damage and notify us of any such damage within 7 days of delivery. Subject to this clause, we will not accept any liability for superficial damage notified outside this 7 day period. For the avoidance of doubt, this does not limit or exclude any rights you may have under the ACL.
All warranty claims must be made prior to the end of the warranty period. Where the Terms and Conditions apply to a supply between Retailer and Customer, then claims must adopt the following procedure and requirements:
(a) The end-user must at its expense either deliver to, or arrange for an infield inspection from, the authorised technician from which the Product was acquired;
(b) The Product must be delivered to, or inspected by, the manufacturer / supplier or the within the relevant guarantee period. All warranty claims must be accompanied by the original receipt;
(c) If supplier / manufacturer determines that the claim is valid, supplier / manufacturer will, at its option, return the repaired Product or provide a replacement Product free of charge;
(d) If supplier / manufacturer determines that the claim under the warranty is not valid, supplier / manufacturer will notify the end-user which will be required to cover costs.
The supplier / manufacturer warranty will not apply where the products have been:
(a) stored or handled inappropriately, negligently or in such a manner as to effect performance and operational life;
(b) installed outside specifications and installation instructions as published by the supplier / manufacturer from time to time;
(c) operated outside specifications, maintenance and operating instructions as published by the supplier / manufacturer from time to time;
(d) modified or altered in any way not approved by the supplier / manufacturer;
(e) damaged from normal wear and tear;
(f) damaged from:
(i) operation at a duty point other than that specified and quoted; (ii) sand or abrasive materials;
(iii) inappropriate chemicals or additives to the water including corrosive, saline or abrasive water or liquid;
(iv) electrolytic action;
(v) abnormal conditions including pressure, stress or liquid temperature beyond the recommended range;
(vi) incorrect voltage or ‘unclean’ electrical supply;
(viii) Acts of God including but not limited to lightning strikes or high voltage spikes;
(ix) the lack of reasonable and proper use, maintenance and repairs; or
(x) repairs or maintenance conducted by unauthorised persons.
The supplier / manufacturer warranty will not apply to:
(a) the replacement of the consumables of the Products. Consumables means but is not limited to diaphragms, mechanical seals, bearings or capacitors;
(b) defects caused by products, components or services that have been supplied to the supplier / manufacturer by third parties.
Pursuant to the Australian Consumer Law, this clause applies in respect of any of the Products (excluding Services) supplied under this clause which are of a kind ordinarily acquired for personal, domestic or household use or consumption. To the extent permitted by law, supplier / manufacturer’s liability for failure to comply with a guarantee that applies under the Australian Consumer Law, is hereby limited to, in the case of the Products, at the supplier / manufacturer’s option, any one or more of the following:
(a) the replacement of the Products or the supply of an equivalent product;
(b) the repair of the Products;
(c) the payment of the cost of replacing the Products or of acquiring an equivalent product; or
(d) the payment of the cost of having the Products repaired.
Issues not considered a faulty product that are neither minor nor major problems include:
- fair wear and tear of a consumable product or aspect of the product (e.g. diaphragms)
- change of mind – for example, the consumer no longer likes the colour of an item of clothing
- a defect due to abnormal use – for example, a pool cleaner is broken by being dropped.

Replacement Cartridge Filter Warranty
There are specific things you can do to maximise the life of your filter:
- Maintain the pool water chemistry in proper balance.
- Clean the cartridge in accordance with its cleaning instructions.
- Do not scrub the filter with a stiff brush.
- Do not use a high pressure hose.
- The cartridge is used to filter flocculants and not adequately cleaned after use.
- Rotate two cartridges to prolong the life of the filters considerably.
- Your filter will require replacing every 1 - 2 years
This Limited Warranty is void if:
- The filter cartridge has been subjected to alteration, neglect, misuse or abuse of the filter cartridge or filter housing, including spas and pools that are plumbed incorrectly.
- The failure is caused by accident, acts of God or other causes beyond the control of the manufacturer.
- Damage due to water freezing inside filter housing.
- Failure to maintain proper water chemistry and chemical balance.
- The use of abrasive or improper cleaning solutions or cleaning methods.
- The filter cartridge is used with in-floor pool cleaning systems.
- The cartridge is used to filter flocculants and not adequately cleaned after use.
The liabilities of Water TechniX Filters are limited solely and exclusively to the replacement of the cartridge and freight to the original recipient and do not include any labour, installation, losses, expenses and liability for incidental, consequential damages of any kind.
All cartridges under warranty claims must either be returned to Mr Pool Man for inspection, or photos emailed to us with a detailed description.
Returns and Refunds
All Orders that were incorrectly purchased or “change of mind” will incur a flat $10 return shipping label fee that will be deducted from your refund.
- Your return will be processed within 10 business days of being delivered at Mr Pool Man
- Any initial shipping costs are not refunded
- Orders placed using a discount code are eligible for store credit only
If you are returning an order that is outside of the 60 day easy returns window, please contact us with your order details
Pool Cover(s), Pool Roller(s), Pool Heater(s), Filtration media(glass & sand) and mineral salts are not eligible for Returns or Refunds due to orders being of custom sizes and our return carrier is Australia Post which do not accept consignments of that size or weight. All Pool Cover(s) Pool Roller(s) and Pool Heater(s) Filtration media and mineral salt sales are final unless standard warranty policies apply.
Items must be returned within 60 days from the day you've received your order, transit times are not included within this time.
Mr Pool Man currently does not offer exchanges, a refund against your original payment method will be processed upon receiving your return minus any return fees if applicable. If you require a different product, you'll need to place a new order via the website for this product.
Returned products must be unused and in original condition. Any items found to be in poor condition or missing components will not be accepted and returned back to you.
If you have purchased and used a product, we cannot accept a return because of a change of mind. eBay and online forums are excellent resources if you have a used item you do not want that can no longer be returned to Mr Pool Man. All items are thoroughly inspected before any action is taken.
Orders placed separately (unique reference numbers), must be returned separately. Combining orders being returned in one package will significantly slow down refund processing speed.
Any item being returned must be registered through our Returns Center. Following this process will ensure a resolution (refund) is processed as quickly as possible.
If returns are not raised through Returns Center processing refunds may take longer than 5 working days. Please keep a copy of any postage receipts and necessary tracking information as proof of return as you are responsible for the safe delivery back to Mr Pool Man of the item for processing.
If any item returned breaches any of the terms outlined in this policy, we reserve the right to return the item back to you in the same condition it was received in.
All refunds will be returned via the payment method used at checkout. In the event that we're unable to refund directly to your account, we will contact you for other options.
Free returns are offered to orders which are damaged or the incorrect item has been received only. If in any circumstance you pay for return shipping Mr Pool Man will not reimburse postage costs. One return label will be issued via PDF email attached if Mr Pool Man is paying for the return postage.
These Conditions of Sale form the entire agreement between you and us.
We may change any provision in these Conditions of Sale without notice so we advise that, even if you are a frequent purchaser from us, you check these Conditions of Sale whenever you want to purchase products from us. Any change of these Conditions of Sale will only apply to future orders. None of our agents or employees or any third parties have any authority to change these Conditions of Sale.
We will not be liable for any delay or failure to perform our obligations under these Conditions of Sale if such delay is due to any circumstance beyond our reasonable control. If we are delayed from performing our obligations due to such a circumstance for a period of at least 3 months, we may terminate our agreement with you by giving you 5 business days’ written notice.
We reserve the right to terminate our contract with you or terminate your account with us.
You must not assign any rights and obligations under these Conditions of Sale whether in whole or in part without our prior written consent.
If any provision of these Conditions of Sale is invalid, illegal or unenforceable, these Conditions of Sale take effect (where possible) as if they did not include that provision.
These Conditions of Sale are governed by the laws of New South Wales, Australia. The parties each agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
